I was going through a divorce last year and no it will actually be far easier to do it if he is not around.The judge will rule in his absence.Ofcourse he will be notified prior to any hearings.
Do you think he would fight for custody? That is one of the most major issues in any divorce,but more so when you have a partner from another country.So many times the partner will take the child and go back to *his* or *her* family.If you think he would be ok with a divorce,and not fight any issues you can write up a dissolution,and send him a copy to be signed.He is ofcourse supposed to be present for the hearing(for dissolution it lasts about 15 minutes),but he can wave that.
If you expect problems you can go directly the divorce route,or switch over from a dissolution.LMTY the lawyers will kill you financially.You can get the basic paperwork,filings all done on your own.Most places have the forms online now. I wish I had gone that route and saved the money,but was uneducated in this area and afraid since dh hired a very aggressive male lawyer.If there ever is a next time for me I will just do it myself.
Even though you are just seperated you might want to look into filing for custody,and if not getting support,you can file for that too.
Most states you can actually file for child support through the agency and not through the courts.
